Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WiseResume websites, applications, and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old and legally able to enter these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.
2. Subscriptions, Billing, and Renewals
Paid plans are billed in advance for the applicable term. Unless canceled before renewal, subscriptions automatically renew at the then current rates. Fees are non-refundable except where required by law. We may change pricing on renewal with prior notice.
3. Acceptable Use
You will not: (a) reverse engineer or modify the Service; (b) use it for unlawful, infringing, or harmful purposes; (c) attempt to gain unauthorized access; (d) interfere with or disrupt the Service or its security; or (e) misuse AI outputs in ways that violate applicable law, including generating discriminatory, misleading, or harmful content.
4. Customer Content
You retain ownership of content you submit (e.g., resumes, job descriptions, profile data) ("Customer Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, process, and use Customer Content to provide and improve the Service, including AI processing. You are responsible for ensuring you have rights to submit Customer Content and that it does not infringe third-party rights.
5. AI Outputs and Disclaimers
AI-generated suggestions may be inaccurate or incomplete. You are solely responsible for reviewing and using outputs. Do not rely on AI outputs as legal, financial, or professional advice. We do not guarantee outcomes such as job placement.
6. Privacy
Our use of personal data is described in our Privacy Policy. By using the Service, you consent to those practices.
7. Third-Party Services
The Service may rely on third-party providers (e.g., AI, hosting, analytics, payment processors). Their use may be subject to their own terms. We are not responsible for third-party services we do not control.
8. Security and Confidentiality
We implement reasonable technical and organizational measures to protect the Service and Customer Content. No system is perfectly secure; you provide content at your own risk. Each party will protect the other’s confidential information with reasonable care.
9. Availability and Support
We strive for reliable Service but do not guarantee uninterrupted or error-free operation. Planned or emergency maintenance may affect availability. Support offerings, if any, are described in your plan.
10. Suspension and Termination
We may suspend or terminate access for breach of these Terms, misuse of the Service, or to address security or legal risks. You may cancel at any time; fees are non-refundable except where required by law.
11. Intellectual Property
We and our licensors own all rights in the Service and related materials. Except for the limited rights expressly granted, no rights are transferred to you.
12. Indemnification
You will indemnify and hold us harmless from claims arising out of your Customer Content, your use of the Service, or your violation of these Terms.
13. Warranty Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data.
15. Governing Law and Venue
These Terms are governed by the laws of the jurisdiction specified in your billing address, without regard to conflict-of-law principles. The courts located in that jurisdiction have exclusive jurisdiction for disputes arising from these Terms, and you consent to their personal jurisdiction.
16. Changes to the Service or Terms
We may modify the Service or these Terms. Material changes will be notified via the Service or email. Continued use after changes constitutes acceptance. If you do not agree, stop using the Service.
